Appeal judges refuse to cut heroin dealer's 7-year jail sentence

A DRUG dealer caught with heroin three times in just 10 months has been told by senior judges he deserved every day of his jail term.

Peter James Phillips was stopped by police and found with increasing quantities of the class A drug between March 2009 and January last year, a court heard.

The 38-year-old, of Birches Head Road, Sneyd Green, was jailed for seven years at Stoke Crown Court in June last year, after admitting counts of possessing heroin with intent to supply.

He challenged his sentence at London's Criminal Appeal Court, with lawyers arguing it was too long.

But his appeal was dismissed by senior judges, who said seven years was "not excessive", given the "seriousness" of his crimes.

The court heard Phillips was caught with 4.3 grams of heroin on him in March 2009 and was arrested and released on bail.

He was then stopped in November 2009 and caught with 42.8 grams of the drug, and again in January last year – with 118 grams on him.

Mr Justice Nicol, sitting with Lord Justice Moore Bick and Sir Hugh Bennett, told the court Phillips had a "lengthy record", including previous convictions for drugs possession. He said the jail term was "not excessive", in light of Phillips "persistent offending".
